These Terms and Conditions ("Terms") govern your access to and use of services provided by The Contractor’s Academy Limited ("TCA", "we", "us", or "our"). By using our services, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using our services. If you do not agree to these Terms, please refrain from using our services.

1. Definitions

  • "TCA" refers to The Contractor’s Academy Limited.
  • "User" or "you" refers to any individual or entity purchasing and using our services.
  • "Services" refers to both our "How to Become a Contractor" e-learning course and "SME Consultation" services.
  • "Course" refers to our "How to Become a Contractor" e-learning course.
  • "Consultation" refers to our "SME Consultation" service.
  • "SME" refers to Subject Matter Experts or partners engaged in consultations with the user.

2. Product and Services

2.1. How to Become a Contractor Course

Our e-learning course is designed to help individuals become successful contractors. The course consists of nine modules and is hosted on Moodle, accessible via most smart devices.

  • The course content is developed using the Articulate suite.
  • Upon purchasing the course, users will receive lifetime access, subject to TCA’s continued operation.
  • Course content and access may be revoked or altered if TCA ceases trading or is sold. In such circumstances, these Terms may be altered or nullified.
  • The cost of the course will be as displayed on the website at the time of checkout. Prices are subject to change based on market conditions and promotional campaigns.
  • TCA reserves the right to edit and update the course content at any time to ensure it reflects any significant changes in market conditions, regulations, or other factors that TCA may deem relevant to the course’s ongoing accuracy and effectiveness.
  • No refunds are provided for the purchase of this course.

2.2. SME Consultation

We offer one-on-one consultations with contracted subject matter experts or partners.

  • Each session lasts approximately 45 minutes.
  • Sessions may be terminated early by the SME in their capacity as the call moderator.
  • Consultations can be rescheduled up to 24 hours before the scheduled session time. Missed consultations are non-refundable, but rescheduling may be offered at TCA’s discretion.
  • Full refunds will be offered for any cancellations occurring before 24 hours of the scheduled SME consultation. 
  • SMEs reserve the right to terminate a consultation if any abusive or hate speech is demonstrated by the user. Such behaviour will not be tolerated, and refunds will not be provided in such cases.
  • Consultations may be recorded for training, monitoring, and quality control purposes.
  • Although it is recommended that SMEs have their cameras on during consultations, this is not mandatory. In certain circumstances, consultations may occur with the camera off.
  • SMEs may cancel or reschedule consultations at any time. If a session is cancelled and cannot be rescheduled, the user will receive a refund within 7-21 working days.
  • Users must provide accurate and truthful information when booking a consultation. Failure to do so may result in cancellation, with no guarantee of a refund.
  • The consultation price will be displayed on the website at the time of checkout and may vary due to market conditions or promotional campaigns.
  • SME consultations are subject to the availability of the SME. TCA makes no guarantee of a minimum or maximum number of available consultation sessions per financial year and holds no obligation to provide such availability.

3. User Accounts

To access our course or schedule consultations, you may be required to create a user account. By creating an account:

  • You agree to provide accurate and complete information during the registration process.
  • You are responsible for maintaining the confidentiality of your account details and password.
  • You accept full responsibility for all activities that occur under your account.
  • TCA reserves the right to terminate or suspend accounts at its discretion.

4. Refund Policy

4.1. How to Become a Contractor Course

All purchases of the e-learning course are non-refundable.

4.2. SME Consultations

Refunds will be provided only in cases where the consultation is cancelled by the SME and cannot be rescheduled. Any other cancellations or missed sessions are subject to the discretion of TCA, and refunds may not be provided.

Refunds, where applicable, will be processed within 7-21 working days.

5. Intellectual Property and Usage

All content within the "How to Become a Contractor" course, including but not limited to text, graphics, logos, images, audio clips, video content, and software, is the intellectual property of TCA or its licensors.

  • You are granted a limited, non-exclusive, non-transferable licence to access and use the course materials for personal and educational purposes.
  • You may not reproduce, distribute, modify, or create derivative works based on the course content without our express written consent.
  • The sharing of accounts is strictly prohibited. Each account is intended for individual use only, and any attempt to share your account or login credentials will be considered unlawful distribution of our materials and services.
  • All rights not expressly granted under these Terms are reserved by TCA.
  • Failure to comply with any of the above provisions regarding intellectual property may result in legal action being taken against you to protect our rights and interests.

6. Privacy

Your personal information is collected and used in accordance with our Privacy Policy. By using our services, you agree to the collection and use of information as outlined in our Privacy Policy.

7. Amendments

TCA reserves the right to modify or update these Terms at any time. Any changes to the Terms will be posted on our website, and it is your responsibility to review these Terms regularly.

By continuing to use our services after any changes are made, you acknowledge and accept the updated Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the use of our services will be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Liability 

9.1 No Guarantees or Promises

The Contractor's Academy Limited ("TCA") makes no guarantees, representations, or promises regarding the individual outcomes of users who purchase the "How to Become a Contractor" course or engage in SME consultations. The course and consultations are designed to provide educational content and guidance, but success in contracting or business ventures depends on numerous factors beyond TCA’s control, including the user’s personal circumstances, actions, and external market conditions.

9.2 Personal Responsibility

Customers are strongly advised to conduct their own independent research and consider personal nuances when applying the information provided through our course or consultations. The content provided is general in nature and may not take into account individual goals, needs, or financial situations.

9.3 No Financial Advice

TCA is not a regulated entity under the Financial Conduct Authority (FCA) or any other financial regulatory body in the UK. Therefore, we are unable to provide any form of financial advice.

Where matters of finance, investment, or business structuring are discussed during the course or in consultations, these discussions are intended for educational purposes only. We recommend that customers seek advice from a qualified and regulated financial adviser before making any decisions related to finance or business.

9.4 Limitation of Liability

To the fullest extent permitted by law, TCA and its directors, employees, affiliates, partners, or SME consultants will not be liable for any loss, damage, or harm (whether direct, indirect, incidental, or consequential) arising from:

  • Use of the "How to Become a Contractor" course or SME consultations;
  • Reliance on any information provided in the course or consultations;
  • Failure to achieve intended results from applying the course content or advice received during consultations.

9.5 Indemnification

By using our services, you agree to indemnify, defend, and hold harmless TCA, its affiliates, partners and suppliers, employees, and contractors from and against any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the course, consultations, or any breach of these Terms.
